Biography:
Mr. Scheer is a principal of SLG. He graduated from the University of Massachusetts (B.A., cum laude, 1980), and earned his Juris Doctor Degree from Empire College of Law (1983). After clerking for Alan Jaroslovsky (Bankruptcy Judge, N Dist of CA), Mr. Scheer worked as Bankruptcy Administrator and In-House counsel for World Savings and Loan Association, a Fortune 500 Company. Mr. Scheer then went on to work for the AV rated Firm of Polk, Scheer & Prober from 1984-2002, becoming a shareholder and Managing Principal in 1993
Mr. Scheer has received an AV (highest rating) from Martindale-Hubbell and received a designation as a Northern California “Super Lawyer” by the Thomson Reuters group. He is an effective and successful litigator and has handled over 200 jury and non-jury trials in State and Federal courts, focusing on creditor and real estate litigation matters
In 2005, Mr. Scheer spearheaded the cooperative efforts of a regional bank, title companies and TIC counsel, resulting in the release of the first known institutional retail Tenant in Common loan program in the State of California
Why I would like to be a member of the board of directors and/ or my vision for UTA:
The effect of the pandemic on Lender and Trustee rights and regulations cannot be understated. Despite the cessation of the state of emergency, the laws governing lender/borrower/trustee rights continue to be heavily regulated as if the pandemic has continued. In many cases, the laws have been used to promote and impose social agendas such as affordable housing on the legal and foreclosure process. This has resulted in onerous, confusing and in many cases unwieldly burdens on lenders and trustees. It is likely that the economic jolt and increase in property values resulting from spending billions of dollars during the pandemic has finally dissipated and that there will be pressures on real estate and job markets in the near future. This will likely result in more regulatory pressure on lenders and trustees.
If elected, I would bring practical day to day experience as a litigator and counselor to UTA lenders and trustees. If elected I would bring sound advice and counsel to the UTA Board and members on current issues and problems faced by UTA members and to interact with UTA legislative lobbyists to seek a balance on laws and regulations facing lenders and trustees.
