Benjamin Levinson

What do you do, and for what company?

I am a California licensed attorney that has been representing for over 36 years private mortgage lenders, foreclosure trustees, and receivers in State Courts and all Bankruptcy Courts in California.  My practice emphasizes representation of secured and unsecured creditors in bankruptcy; defending lenders, foreclosure trustees, and third party purchasers in foreclosure-related litigation; lender and receiver representation in state court receivership actions; and lender representation in judicial foreclosures. I also handle legal actions related to disbursal of surplus funds from foreclosures.

What sets you apart from the competition?

I have a great understanding and years of experience in dealing with the issues that lenders and other clients face in Bankruptcy Courts in all Districts of California and in California state courts. This is especially beneficial to clients when the real estate market rises and falls as it has done over the last 36 years a multitude of times.

What is the value of UTA for you?

UTA provides education for its members with webinars, small seminars, legislative lobbying day, and its annual conference.  Members have the opportunity to get immediate access to new laws and are made aware of other potential laws that could, directly and indirectly, affect their industry.

As a member for over 25 years, I have made great friendships within the industry.  I also have the opportunity to network with clients, meet new members, including attorneys, and share our knowledge with each other and the general membership.

What motivates you both in our industry and as a UTA board member?

I am motivated to help our members stay informed about the ups and downs of the real estate industry and how bankruptcy courts are dealing with current real estate issues.  As a UTA board member, I am able to meet with other board members to develop strategies to help our industry survive with all of California and national legislation attempting to stifle our industry.

If you could change or revise one thing about the default industry, what would it be?

I would love to see more experienced persons on legislative staff to guide the legislators to be more neutral in their enacting of legislation that is short-sighted and detrimental to the parties that the legislators claim they are protecting.

What is your vision for our industry over the next 12 months?

Unfortunately, the industry will continue to suffer over the next year due to COVID-related issues.  It is my hope that eventually laws enacted from the Great Recession and the COVID pandemic can sunset so that the economy can get back to its normal ebb and flow.  I would also like to see the reduction of non-meritorious litigation that always follows laws enacted during those times of crisis.
