10:30 AM Mobile Home Foreclosure Issues

This session will deal with Manufactured/Mobilehome foreclosures including the crucial pre-foreclosure determination of the home's status as chattel (personal property) or real property. The session will explain how to foreclose on a manufactured/Mobilehome in California and Nevada (1) as personal property in a Mobilehome park or private property; (2) as part of a combination of a personal property home and real property; and (3) as a fixture to the real property when a home has been properly affixed and converted to real property. Finally, the session will deal with the procedures to convert a personal property manufactured/Mobilehome to real property or to correct an illegally converted Mobilehome back to personal property.

Short Sales, Short Sale Fraud, Sold out Junior lienors, Waste , Fraud and Judicial Foreclosures are all areas that can allow rights to collect, but there are dangers and limitations. The panel will cover new legislation, cases, and practical considerations that affect Lenders, Trustees and Investors when faced with options to foreclose and how to preserve the rights to collect when the security is gone.

Here’s your chance to take UTA’s certification exam and become a UTA certified Trustee Sale Officer without sitting through the course. UTA certification is designed so that employers and consumers alike will have the confidence in the recipient’s thorough knowledge of the nonjudicial foreclosure process. Non-members may take the exam(s) but may not be certified unless they become a member within 60 days of sitting for and passing the exam.

The certification challenge is also offered at 3:15 pm on Monday.
