Update: Mediation Notice Requirements to Grantors in Oregon
In a recent article in the UTA eNews, members were informed that “SB 628, legislation mandating enhanced mediation notice requirements to grantors in Oregon, had been signed into law and that Oregon Department of Business and Consumer Services (DCBS) - the agency charged with implementing the bill - would update relevant forms several weeks prior to the bill’s operative date (September 29, 2009). Once that form is available, DCBS will post it on its website.”
The notice and instructions are posted on their website
On this page, go to the “Licensee information” section and to the bullet:
• Foreclosure Notice (required by House Bill 3630 - 2008) Modified by Senate Bill 628 (2009)
Required foreclosure notice and loan modification request process.
Or simply click here to find a summary of the new requirement and the timeline for its use.
We have been informed by the Department of Consumer & Business Services that with respect to the modification form, DCBS has determined that the new law does not give the Department any authority to recommend either a model request for modification form or a model affidavit.
