California AG Issues Subpoenas to Trustees

The California Attorney General’s office has issued at least two subpoenas to trustees as part of an investigation into “the business practices or mortgage servicers, mortgage lenders, mortgage trustees and other participants in the mortgage financing, servicing and foreclosure process.”
The subpoenas request an enormous amount of documentation – essentially each and every Deed of Trust, NOD, and Trustee’s Sale Notices and for the past three years. The production of such detailed documentation can cost the trustee companies several hundred thousand dollars alone.
It is not known at this time what exactly the AG is looking for. The Subpoena seeks information and documents concerning every Assignment, Substitution of Trustee, Notice of Default, Notice of Sale and Trustee’s Deed Upon Sale prepared from 2009 to the present.
