Constitutional Challenge to Nevada Foreclosure Mediation Program Denied  Michael R. Brooks, Esq. Michael Brooks, Esq., Brooks Bauer reports on a Constitutional challenge prepared by his firm to Nevada’s foreclosure mediation program. Brooks stated: “I am sorry to report that the Washoe County District Court judge hearing the matter found that the program is Constitutional. We don’t agree with the ruling and I am confident that this is not the end of the discussion.” Michael added: “My only comment on the decision is this: The court was tasked with providing an answer to one question: ‘Where is the case or controversy that will result in a final judgment upon which all judicial authority must rest?’ After reviewing the decision, we still cannot identify a case or controversy.” |
