Washington Attorney General Enforcing
and Interpreting Physical Presence Requirement

The Attorney General of Washington, Robert McKenna has sent a letter to several trustees who do business in the State of Washington indicating his intent to enforce the Deed of Trust Act in the state which mandates that trustees “must maintain a physical presence [in the state].”  Further, the letter states that “having only an agent for service of process has not been sufficient since the Act was amended, effective June 12, 2008, to require a physical presence.”
