Riverside County, California Ordinance Would Prohibit Trustee Sales on County Property

Riverside County is considering adopting an unacceptable Ordinance that would prohibit solicitation on County Property. UTA Counsel Phil Adleson testified before the Board of Supervisors on March 29th and again on April 12th as did Felita Kealing, UTA Board Director, LPS Agency Sales & Posting, along with Richard Meyers, UTA’s Executive Director. Meyers pointed out that a change in location would require at least a lead time of 365 days.
“Our members have grave concerns about the policy set forth by a potential ordinance that would prohibit solicitation on County property,” said UTA President Robert Finlay, in a letter to the Board of Supervisors. The letter detailed the tremendous problems that that implementation of the ordinance would create and requested a meeting to address and resolve the matter (excerpted here):
“The unintended consequence of prohibiting sales on County property will inevitably be the spreading of trustee’s sales throughout various public/private locations in the County causing a reduction in competitive bidding … The inability of trustees to conduct sales on County property will have a negative impact on lenders and servicers desires to enter modifications … Additionally, should notices have to be re-published to a new sales location, surplus funds due to Riverside homeowners from a third-party sale will be reduced.”
“We believe this potential ordinance … will have a negative effect … on property taxes and the ability of homeowners and others to reinstate or redeem their properties.”
“We respectfully request that the County repeal the ordinance’s effect date until at least we can meet with representatives of the County along with other interested parties and resolve this issue.”
Members are asked to send a letter to each of the five members of the Riverside County Board of Supervisors. A draft letter for members to sign can be found here. The draft letter requests opposition to the ordinance or at the least a delay in implementation until the Board has met with UTA.
