California Civil Courts Closing Third Wednesdays;
Santa Cruz County Recorder Office Closed on Fridays

California Civil Courts are closing on the third Wednesday of each month.  How does that affect the calculation of time based on the number of business days specified in the statutes that pertain to trustee’s sales?

Civil Code Section 9, Government Code Section 6700 and Code of Civil Procedure Section 12 and 12a govern. The real answer, though, may be provided in Code of Civil Procedure Section 12b:

12b. If any city, county, state, or public office, other than a branch office, is closed for the whole of any day, insofar as the business of that office is concerned, that day shall be considered as a holiday for the purposes of computing time under Sections 12 and 12a.

So it appears that only court business is affected by the Wednesday court closure.

In related news, the Santa Cruz County Recorder’s office has announced that they will not be open on Fridays.  Please keep this in mind with your Sale dates.
