Nevada Tenant Protection In Foreclosure Bill Signed Into Law (AB 140)
AB 140, part of Nevada’s legislative leadership’s plan to protect tenants in the foreclosure process, placed notification requirements on the trustees in owner occupied properties. AB 140 was signed into law by the Governor. It goes into effect on October 1st.
Like AB 149 (the Nevada mediation bill), this measure in its initial version placed huge burdens on the trustee prior to executing a trustee sale. As the banking and lending communities supported this bill; UTA’s lobbyist, Rocky Finseth, focused on the role of the trustee and worked closely with the bill sponsor to better define the role of the trustee in the notification process.
