HOA Lien Issues Addressed at Conference

Nevada, California and Texas HOA Lien issues will be addressed in detail on Monday, November 10th at 1:30 pm at the La Quinta Resort, during UTA’s 39th Annual Education Conference.

Our expert panel will provide an update on lien issues, including the recent decision SFR Investments Pool 1 LLC v. U.S. Bank, N.A., in which the Nevada Supreme Court ruled that a nonjudicial foreclosure sale of an HOA lien extinguishes a first deed of trust.

The case puts thousands of first liens at risk and UTA’s panel will address why the court decided in this manner, if there are exceptions, what notice is required to the first lien holder in order for the HOA to take precedence, what must be done to protect the first deed of trust in present suits and on future lien claims, whether this is a final decision, and the implications of the ruling in other states.
