UTA Files Brief in Alaska Case

UTA has filed an amicus brief in the case of Bachmeirer v. Alaska Trustee LLC in the Alaska Supreme Court.   The amicus brief addresses the issue of whether a foreclosure trustee can collect its fees and costs as a condition of reinstatement of the loan for nonjudicial foreclosures which occurred prior to the recent changes in Alaska law which clarified this point.  If the decision is upheld, trustees could face liability for collecting fees and costs for prior foreclosures.  UTA retained the law firm of Robinson Tait, P.S. in Seattle, Washington to file the amicus brief.  Joe Solseng, Esq., a prinicipal at Robinson Tait and a member of the Alaska State Bar, filed the brief with assistance from Phil Brenneman, Esq., another attorney at Robinson Tait.
