UTA Earns 30-Day Reprieve on Sonoma County Moratorium

Sonoma County previously set a March 1st, 2010, drop deal date after which neither trustee’s sale nor postponements may be conducted at 575 Administration Drive, Santa Rose California or at any other County-owned property without the risk of being cited for trespass. Extensive efforts have been taken by UTA and by individual counsel for various members to obtain additional time to resolve the Sonoma trustee’s sale site issue.

Mike Wagner, Real Estate Manager for Sonoma County, by letter dated February 23, 2010 (copy linked), has listed particular trustees and posting and publishing companies who will have an additional 30-day extension (through March 31, 2010) to continue to use the noticed sale site (575 Administration Drive, Santa Rosa) for crying sales and postponements.

In addition to the companies listed in Mr. Wagners’ February 23, 2010, letter, other companies will be granted a 30-day extension if they make similar written requests to the County by Thursday, February 25th and provide to the County a list of noticed sales or postponements for the 575 Administration Drive location by Friday, March 5th. The County notes that they are pursuing other potential locations for reconveyance transactions.

One of the significant items in Mr. Wagner’s February 23, 2010 letter is that the County “requests” that the sales and postponements be moved to the northern side of 575 Administration Drive, Santa Rosa, California. Because different trustee’s and posting an publishing companies notice the sale location differently, each should consult with its own counsel on how to handle this situation. The County will post signs directing potential bidders to the northern side of the building.

UTA’s Counsel, Phil Adleson, had written to the County’s Real Estate Manager, County Counsel and to the entire County Board of Supervisors, on behalf of UTA, requesting that the County reconsider - or at least postpone - the implementation date until the County meets with UTA. That letter pointed out a number of problems arising from the County’s change in policy. Several member companies, including FEI, LLC, Cal-Western Reconveyance; Trustee’s Assistance Corp.; RSVP; Priority Posting & Publishing and LPS – Agency Sales & Posting had also assisted in the postponement, by urging Wagner and the County to find an alternative site, or at least postpone the County-location sale moratorium.
