Reminder: California Recordation of NTS Now 20 Days Prior to Sale Date

One of the myriad of changes mandated by SB 306, signed into California law on August 5, 2009 by Governor Schwarzenegger, was a change in Civil Code Section 2924f requiring a recordation of the notice of trustee sale to at least 20 days prior to the sale date. Recordation of the notice of sale had been 14 days prior to the sale date. The new “14 to 20” requirement for the NTS was effective January 1, 2010.

Members are reminded of this change in order to alleviate the potential of rescission.
