Nevada Legislature Considering Slew of Bills Impacting Trustees
UTA Addressing Each and Every Issue in the State

The Nevada Legislature continues to head toward its conclusion on June 1st. The UTA has identified several bills of significance and is tracking and working with various legislators to address the concerns of members.

UTA’s primary focus is AB 149, which creates a foreclosure mediation process through Nevada's court system and AB 140 which focuses on notification of tenants when the property they are renting falls into foreclosure proceedings. UTA's lobbyist, Rocky Finseth, has been an active participant in the working group formed by the Speaker of the Assembly (the bill's sponsor) and the Chief Justice of the Nevada Supreme Court, to continue to modify and address the concerns of all interested parties.

Also of concern is AB 204 involving an extension of time for the threshold of a super priority lien in a single family detached dwelling and AB 350 which revises provisions relating to the ability of a homeowner's association to collect payments of fines at a reasonable cost. Rocky Finseth continues to meet with other lobbyist who are working with the bill sponsor to modify the measures.

In addition, AB 452, which was another bill of interest to the UTA, died on a procedural matter and is unlikely to see further consideration.

UTA's lobbyist is also working in Nevada on an amendment to SB 128 which seeks to force recordation of deeds of trusts within a specified timeframe. While the amended version of the measure was a substantial improvement over the original bill, UTA is seeking to clarify third party recordation actions.
