UTA Hires Lobbyist in Nevada To Address Legislation Requiring Mandatory
Mediation to Negotiate Loan Mods

UTA has hired a lobbyist, Rocky Finseth, President & CEO of the Carrera Group, in Carson City, Nevada, to work to defeat or amend legislation, that is “impractical, unreasonable, and quite honestly, indefensible,” according to Rande Johnsen, Trustee Corps, President of UTA.

Rocky Finseth has over 17 years of experience developing public policy at a federal, state and local level of government. Among his current clients include the Nevada Land Title Association.

As previously reported in the UTA eNews, legislation has been introduced in the Nevada legislature (A.B. 149) that would require all foreclosures to be served a 60 day notice and give the trustor the authority to request mandatory mediation to negotiate a loan modification, at which the trustee is required to appear. If a trustee does not attend the mediation with proper documents, such as a copy of the note, or authority, the judge would be allowed to modify the loan as he/she sees fit. ‘Loan modification’ is not defined.

A joint hearing was held on Wednesday, February 11th by the Assembly and Senate Commerce & Labor Committees. Michael Brooks, Esq., of Jolly Urga Wirth Woodbury & Standish, testified on behalf of UTA at the hearing and Scott Sibley, of Nevada Legal News, a UTA member and former member of the Nevada Assembly, joined Michael at the hearing.

AB 149 was introduced by Barbara Buckley, the Speaker of the Nevada Assembly, who will work tirelessly to ensure its passage.

Additionally, legislation has been introduced in the Nevada Assembly, AB 204, that would limit fees associated with HOA liens.

We are requesting that members contribute to our efforts to retain this lobbying representation in Carson City, Nevada for the entire legislative session. We are seeking to raise $20,000 from members, especially from members who conduct foreclosure sales in Nevada.
